Terms of Service

1. Description of Service

LeadScript AI provides a continuous data-monitoring and removal service ("Digital Privacy Shield"). We act on your behalf to submit opt-out and deletion requests to third-party data brokers, people-search websites, information aggregators, and centralized state registries (collectively, "Data Brokers").

2. Limited Power of Attorney and Authorized Agent Designation

By purchasing this service and checking the consent box at checkout, Client grants LeadScript AI a limited power of attorney to act as your Authorized Agent under applicable state and federal privacy laws, including but not limited to the New Jersey Data Privacy Act (NJDPA), the California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), the California Delete Act (including utilization of the Delete Request and Opt-Out Platform - DROP), and other similar comprehensive state privacy legislation.

You authorize LeadScript AI for the sole and exclusive purpose of submitting opt-out, deletion, and do-not-sell/share requests directly to Data Brokers, or via centralized state-run deletion platforms, that collect, sell, or share your Personally Identifiable Information (PII). LeadScript AI is not authorized to act on your behalf for any other legal, financial, property, or personal matters.

3. Client Obligations and Accuracy of Information

To effectively perform the Service, Client must provide accurate, current, and complete information via our secure intake form.

Client agrees not to provide false information or attempt to use this service to remove data belonging to a third party without their explicit legal consent.

Client understands that failing to provide accurate past addresses, aliases, or relative names may severely limit our ability to locate and remove profiles from Data Brokers.

4. No Guarantee of Permanent Removal (The "Best Efforts" Clause)

Client acknowledges that Data Brokers continuously scrape public records (such as property deeds, marriage licenses, and voter registrations). Therefore:

• LeadScript AI operates on a "best efforts" basis and cannot guarantee permanent, 100% removal of all personal data from the internet.
• We do not control the databases of third-party Data Brokers, nor can we control their compliance speed.
• Excluded Records: This service cannot and does not attempt to remove direct government public records (e.g., county property tax databases, court records) or journalistic content (e.g., news articles, blog posts) as these are not governed by Data Broker privacy laws.
• If a Client triggers a new public record (e.g., buying a new home), Data Brokers may generate a new public profile. Our continuous monitoring service is designed to identify and submit removal requests for these repopulated records as they appear.

5. Limitation of Liability

To the maximum extent permitted by law, LeadScript AI and its officers, employees, or software partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to emotional distress, loss of privacy, or financial loss arising from:

• The failure of a third-party Data Broker to comply with a deletion request.
• The repopulation of your data by third parties.
• Any unauthorized access, hacking, or data breaches occurring at the third-party Data Brokers or our secure white-label software partners.

Our total liability for any claim arising out of or relating to these Terms shall not exceed the total amount paid by the Client to LeadScript AI for the 12 months preceding the claim.

6. Payment, Term Commitment, and Refunds

• Payment Structure: The Service consists of a one-time Initial Setup & Deep Sweep fee, followed by a recurring Monthly Retainer, at the rates presented during checkout. The setup fee and first month's retainer are billed immediately upon purchase. Subsequent monthly retainers will be automatically billed to the payment method on file every 30 days.
• 12-Month Minimum Commitment: Because LeadScript AI incurs significant upfront licensing costs and deploys heavy manual labor during the initial deep sweep, this Service requires a minimum 12-month commitment.
• Refunds: The Initial Setup fee is strictly non-refundable once intake processing begins, due to the immediate, unrecoverable costs of deploying third-party compliance software and authorized agent labor.
• Cancellation: Following the completion of the initial 12-month term, Clients may cancel their month-to-month subscription at any time via their client portal or by emailing owner@leadscriptai.com. Cancellation prevents future billing, but no prorated refunds will be issued for the current billing cycle.
